Terms and Conditions

These terms and conditions form part of an agreement between Experiential Tasmania Pty Ltd (ABN 70 678 076 287) (“we” or “our”) and the guest(s) referred to in the booking form (“you” or “your”).

1. HOW TO BOOK

You may check availability and make a booking through our website, by calling, or emailing us. Full payment is required to confirm your booking. Upon booking, you’ll receive a confirmation email. By making a booking, you agree to these terms and conditions. If booking for others, you bind all travelers to these terms.

2. DEFINITIONS

Guest: Any individual who makes a booking or participates in an experience provided by Experiential Tasmania.

Experience: Any tour, walk, or activity organised by Experiential Tasmania.

Recreational Services: Services that involve participation in a sporting activity or similar leisure-time pursuit, or any other activity that involves a significant degree of physical exertion or physical risk undertaken for recreation, enjoyment, or leisure.

3. PRICING

Prices on our website are current and subject to minimum numbers. The following are excluded from pricing:

Travel insurance

Tips, personal clothing, medical expenses, items of a personal nature 

Emergency evacuations

National Park entry fees (guests must have a valid Parks pass, where applicable)

A 15% surcharge applies on Tasmanian statewide public holidays, including substitute holidays.

4. PAYMENT

All pricing is in Australian dollars. Bookings are confirmed upon our confirmation. Full payment is due at time of booking. Subsequent discounts will not apply retroactively. Payments are processed via Square, accepting Visa, Mastercard, and Amex with a 2.2% credit card surcharge. Direct deposit payments are fee-free upon request. Payment fees are subject to change, with current fees specified on our website.

5. CANCELLATION BY GUEST

To cancel your booking, notify us as soon as possible. Cancellation fees apply as follows:

More than 14 days from departure: 25% cancellation fee per person, balance refunded

Between 7 and 14 days prior: 50% cancellation fee per person, balance refunded

Within 7 days of departure: No refund

No refund for failing to arrive on time or non-payment of the balance. Voluntarily leaving the experience or being directed to leave due to behavior issues will not result in a refund. We strongly recommend travel insurance.

For the Freycinet Walking Tour, no refund will be provided if you arrive on the day of departure with inappropriate footwear and are unable to join the walk (refer to condition 14).

6. BOOKING AMENDMENT BY GUEST

To change your booking, notify us as soon as possible:

Amendments up to 14 days before departure: No cost, subject to availability

Changes 7 to 14 days prior: $25 change fee per order, subject to availability

No changes accepted within 7 days of departure

Changes may incur additional costs for price differences. We will do our best to accommodate preferred dates.

7. CANCELLATION BY US

Experiential Tasmania reserves the right to cancel any tour at any time, including at late notice, due to unforeseen circumstances, safety concerns, extreme weather conditions, or any other reason beyond our control, including but not limited to the unavailability of guides. In such cases, we will provide the following options to the affected guests:

A full refund of the tour price paid.

A credit towards an alternative booking departure date to be used within 24 months, with no additional charges.

A replacement experience that complements your existing travel arrangements (subject to availability).

A replacement experience at a later date convenient to both parties.

Where your experience is canceled by us, we will not be liable for any costs associated with travel to and from the designated departure point, accommodation, or any other expenses incurred by you or your agents as a result of the cancellation, including but not limited to additional costs incurred in sourcing alternative providers, or any loss of reputation or other consequential damages. We therefore strongly recommend that guests and operators obtain suitable travel insurance to cover such costs.

8. MINIMUM GROUP SIZE

A minimum of 2 guests is required to guarantee a departure. For the Freycinet Walking Tour, a minimum of 4 guests is required. Solo travelers' bookings will remain pending until the minimum number of bookings is met. If not guaranteed a week prior, options include transferring to another date or a full refund. A single supplement fee can guarantee departure.

9. TRAVEL INSURANCE

Ensure your travel insurance covers personal accidents, injury, medical expenses, Force Majeure events, emergency repatriation, personal liability, cancellation, delayed flights, lost luggage, and personal effects. Given the nature of our tours, which often take place in remote areas and National Parks, it is essential that your travel insurance includes ambulance cover for emergency medical transport.

For Australian residents, under the Australian Government Medicare Act, it is prohibited for domestic travel insurance products to provide financial reimbursement for ambulance or air ambulance services. We therefore strongly recommend guests:

Take out specific ambulance cover through their health insurance provider or state-based ambulance subscription service; and

Obtain travel insurance that covers other medical expenses and costs associated with evacuation.

10. DIETARY REQUIREMENTS

Notify us of dietary requirements on the booking form. We will endeavor to cater to your needs. If not disclosed at least 72 hours before departure, we may not be able to accommodate, and standard cancellation fees will apply. Additional charges may apply for special dietary requirements not disclosed in advance.

11. GUEST CODE OF CONDUCT

We aim to provide a safe and enjoyable experience for all guests. We expect guests to:

Respect other guests, guides, and the natural environment.

Comply with all health and safety instructions provided by Experiential Tasmania.

Refrain from illegal activities or disruptive behaviour.

Failure to adhere to this code of conduct may result in exclusion from the tour without a refund.

12. DRIVER/GUIDE AND GUEST RESPONSIBILITIES

Our guides may exclude you from the trip for safety or behaviour reasons, with a full refund option. Group trips require consideration for others. The guide ensures the safety, comfort, and enjoyment of all. Illegal acts or disruptive behaviour may result in exclusion without refund.

13. HEALTH AND FITNESS REQUIREMENTS

Ensure you have adequate fitness for the specific experience you are booking. For example, the Freycinet Walking Tour involves walking 10-14km with a light day pack over varied terrain, including beaches, rocky headlands, and bush trails that include some steep inclines and declines. It is your responsibility to read through the itinerary carefully and ensure you are prepared for the physical demands of the experience.

Guests must be in good health and at least moderately fit to participate in physical activities. Some training and preparation may be required before departure. The more physically prepared you are, the more enjoyable your experience will be. Speak with us for more information about health and fitness requirements and preparation.

We reserve the right to refuse a guest the right to participate in an experience on medical or fitness grounds, at our absolute discretion.

14. FOOTWEAR (Walking Tour Specific)

Guests participating in a Walking Tour must wear sturdy lace-up walking boots or supportive walking shoes with firm treaded soles. New boots should be broken in before the walk. Waterproof or water-resistant boots are recommended. Sandals and similar footwear are not acceptable. Inappropriate footwear on the day of departure may result in forfeiting your walk without refund. Contact us for footwear advice if unsure.

15. MEDICAL FORMS AND DOCTORS CERTIFICATES

Guests with a pre-existing medical condition, including allergies, are required to disclose it on their booking form and may be required to supply a doctor’s certificate. This step assists us in ensuring an enjoyable and trouble-free experience for all involved. Failure to disclose medical conditions may result in refusal to participate without refund.

16. ENVIRONMENTAL RESPONSIBILITIES

We operate within various natural settings, including National Parks, and take our environmental responsibilities seriously. Prior to departure, you will be briefed about these responsibilities. Prior knowledge and awareness are extremely helpful. Guests are expected to respect and preserve the natural environment, adhering to guidelines provided by our guides and park regulations.

17. COMMUNICATION AND NOTIFICATION

In the event of a tour cancellation, whether due to operational reasons, safety concerns, or force majeure events, Experiential Tasmania will make every effort to notify guests promptly. Notification will be made using the contact information provided at the time of booking, including email and phone.

Guests are responsible for providing accurate and up-to-date contact information. Experiential Tasmania is not liable for any failure to notify guests if incorrect or outdated contact information has been provided.

We recommend guests check their email and phone messages regularly in the days leading up to the tour for any updates or notifications.

18. PHOTOS

Our driver/guide may take photos for social media. If you do not consent, inform us on the booking form or on the day of departure. Unapproved photos can be removed upon request.

19. WEATHER CONTINGENCIES

Our tours operate in all weather conditions. However, in the event of extreme weather warnings, we will cancel the tour and provide a full refund or an alternative itinerary. Track closures by Tasmanian Parks and Wildlife Service for safety or maintenance may also necessitate changes.

20. EVACUATIONS

In case of injury or illness requiring evacuation, guests bear the full cost of evacuation, including helicopter and ground transportation. Domestic travel insurance does not cover ambulance services under the Australian Government Medicare Act. We strongly recommend:

Ambulance cover through your health insurance provider

Travel insurance covering evacuation costs

21. FORCE MAJEURE

Experiential Tasmania shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, war, strikes, pandemics, natural disasters, government orders, or other force majeure events. In such cases:

We will provide affected guests with options for rescheduling to a future date or receiving a full refund.

We will not be responsible for any costs incurred by guests as a result of the cancellation, including travel and accommodation expenses.

Guests are encouraged to obtain travel insurance that covers force majeure events.

If a force majeure event occurs, we will notify guests as soon as possible and provide available options for rescheduling or refunds.

22. EXCLUSION OF LIABILITY

Guests acknowledge that participating in activities offered by Experiential Tasmania involves inherent risks, including but not limited to physical exertion, exposure to natural elements, and transportation. Guests undertake these activities at their own risk and fully accept and assume all risks and responsibilities associated with their participation.

To the fullest extent permitted by law, guests waive all legal rights of action against, and fully release, Experiential Tasmania and its employees, agents, and contractors from any liability arising from or connected to their death, personal injury, or property damage, howsoever caused, including but not limited to, liability arising from negligence, breach of contract, or breach of statutory duty.

23. LIMITATION OF LIABILITY

Experiential Tasmania's liability to guests for any breach of any express or implied provision of these terms and conditions is limited, at our option, to:

Refunding the price of the goods or services in respect of which the breach occurred

Providing, replacing, or repairing those goods or providing those services again

This limitation applies to direct damages only and excludes indirect, incidental, consequential, or punitive damages, including but not limited to, loss of enjoyment, travel expenses, and accommodation costs, even if Experiential Tasmania was advised of the possibility of such damages. This limitation does not exclude or restrict any rights you have under Australian Consumer Law.

24. INDEMNITY

Guests agree to indemnify, defend, and hold harmless Experiential Tasmania, its employees, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses, including but not limited to legal and professional fees, arising out of or in any way connected with:

Their participation in any experience provided by Experiential Tasmania

Any breach of these terms and conditions by the guests

Any negligent or wrongful act or omission by the guests, including but not limited to, causing damage to property, injuring other participants, or failing to follow safety instructions

Guests are required to notify Experiential Tasmania immediately if any incidents occur that could lead to an indemnity claim.

25. CHILDREN AND MINORS POLICY

Children under the age of 18 must be accompanied by a parent or legal guardian. Some experiences may have age restrictions or require additional waivers for minors. Please check the specific requirements for each experience.

26. PRIVATE TOUR

A supplementary fee of 75% of the full price applies for private experiences on shared tours. Requests for private bookings must be made at the time of booking. Contact us directly for larger groups.

27. GOVERNING LAW AND DISPUTE RESOLUTION

These terms and conditions are governed by the laws of Tasmania. Any disputes arising from or in connection with these terms and conditions shall be resolved through mediation or arbitration, as agreed upon by the parties, before resorting to litigation in the courts of Tasmania.

28. SEVERABILITY

If any provision of these terms and conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remaining terms and conditions, which shall remain in full force and effect.

29. ACKNOWLEDGEMENT

By placing a booking with us, guests acknowledge and agree that we have relied on the representations made by you, including in respect of your circumstances, travel insurance availability, age and medical condition which representations you hereby confirm and warrant are true, correct and complete in every respect.

30. ENTIRE AGREEMENT

These terms and conditions constitute the entire agreement between Experiential Tasmania and the guests, superseding any prior agreements, understandings, or representations, whether oral or written, relating to the subject matter herein.
